High School Football Frenzy Ticket Selling Fundraiser 2023

These Terms of Service (the "Agreement") govern your participation in the high school football frenzy ticket selling fundraiser (the "Fundraiser") organized by Clackamas Ultrazone LLC, commonly known as Ultrazone Laser Tag. By participating in the Fundraiser, you agree to comply with these Terms of Service.

Fundraiser Details:

a. Purpose: The Fundraiser aims to raise funds in support of high school football and athletic programs.

b. Raffle: The Fundraiser involves the sale of tickets for entry into a raffle, where participants have a chance to win various prizes. These prizes may be purchased or donated by individuals, local businesses, or community members.

c. Eligibility: All high school football teams in Clackamas County are eligible to participate in the Fundraiser.

d. Ticket Sales Period: The Fundraiser ticket sales will be conducted from September 1, 2023, to October 15, 2023.

f. Drawing Date and Time: The drawing will be held on Sunday, October 22, 2023, at 6:30 pm. Please note that this date may be subject to change to ensure maximum participation and attendance by coaches or team representatives. Any changes will be communicated in advance to all participants.

g. Drawing Location: The drawing will take place at Ultrazone Laser Tag, located at 16074 SE McLoughlin Blvd, Milwaukie, Oregon.

Expectations of the Football Team:

a) The football team will promote the fundraiser through online channels, social media, school events, and posters.

b) They will collect cash purchases individually or at school functions when Ultrazone Laser Tag is not present.

c) Team members, students, parents or family volunteers, and school staff should promote the event.  It may be most advantageous for a school to appoint a volunteer fundraiser coordinator. 

d) At football games where the Ultrazone Laser Tag booth is present, they will promote the fundraiser and provide instruction on how to locate the booth.

Expectations of Ultrazone Laser Tag:

a) Administer the fundraiser.

b) Provide marketing materials and fund the upfront costs of the fundraiser.

c) Provide online and in-store ticket sales ability.

d) Collect all money raised and coordinate appropriate distribution. 

e) Purchase the prize and facilitate getting prizes to the winner.

f) Staff homecoming football games with a ticket sales booth as schedule and staffing availability allows.

g) Oversee the final drawing and invite representatives from each team to observe the process.

Ticket Sales:

a. Authorized Sellers: Only individuals who have been authorized, such as students, parents, or designated representatives, may sell tickets for the Fundraiser.

b. Approved Locations and Timeframes: Tickets may only be sold at locations and during specific timeframes determined by the School or Clackamas Ultrazone.

c. Price and Payment: The price per ticket will be clearly communicated, and all ticket sales must be made using the approved method of payment. Generally, purchases can be made through cash or credit card transactions. In limited cases, checks may be accepted, but tickets will not be credited until the funds are transferred.

d. Accountability of Sales: Each ticket sold must be accurately recorded, and the proceeds must be promptly returned to Ultrazone Laser Tag as instructed.

e. Availability and Refunds: Ticket availability is on a first-come, first-served basis, and once purchased, tickets are non-refundable. Exceptions may apply in cases where the event is canceled, and refunds may be issued.

f. Ceasing Ticket Sales: Ultrazone Laser Tag reserves the right to cease ticket sales at any time, providing advanced notice to the participants.

g. Entries with incorrect contact information or illegible writing will not be considered.

h. Ultrazone Laser Tag may void any ticket(s) based on fraud, any suspicious circumstances, or any other reason deemed necessary to ensure the integrity of the Fundraiser.

Participation Requirements:

The Raffle is open to individuals who satisfy all legal requirements for participation as defined by the local jurisdiction. Participants must comply with any age restrictions, residency requirements, or other applicable criteria set forth by the local laws and regulations. It is the participants' responsibility to determine compliance with legal requirements.

Ticket Pricing, Availability, and Sales:

a. Price per entry: Each ticket is priced at $5.00.

b. Ticket Sales Locations: Tickets can be purchased through the following methods:

Online: Visit www.clackamasultrazone.com/football to make a purchase or through a designated third-party site.

In-person: Buy tickets at Ultrazone Laser Tag, located at 16074 SE McLoughlin Blvd.

Other Venues: Tickets may also be available for purchase at select venues, sporting events, or activities. Cash purchases require the buyer to legibly provide their name, contact phone number, and the number of tickets purchased.

Ticket Availability and Refunds:

a. Availability: Ticket availability is on a first-come, first-served basis, subject to the quantity of tickets allocated for the Raffle.

b. Refund Policy: Tickets are non-refundable once purchased, except in cases where the event is canceled. In such instances, refunds may be issued.

Responsibilities of Ticket Sellers:

a. Accurate Representation: Ticket sellers are responsible for providing accurate information about the Fundraiser and the event to potential ticket buyers.

b. Compliance with Guidelines: Ticket sellers must adhere to any additional guidelines or instructions provided by the school regarding the ticket sales process.

Prize Draw and Winner Selection:

a. Fair and Transparent Drawing: The Raffle drawing will be conducted in a fair and transparent manner, utilizing a random selection process as determined by Clackamas Ultrazone.  Representatives from each participating team will be invited to observe the process. 

b. Winner Notification: Winners will be notified via phone call and/or text message using the contact phone number provided at the time of ticket purchase.

c. Claiming Prizes: Winners must respond and claim their prizes within a period of five calendar days. Failure to do so may result in the selection of an alternate winner.

d. Participants are responsible for providing accurate and legible names and contact information. If the name or contact information is not legible or incorrect, the ticket will be voided, and a new ticket will be drawn.

Prize Acceptance:

a. Winners must accept and claim their prizes within seven calendar days from the date of the drawing.

b. Prizes are non-transferable, and no cash alternatives will be provided unless expressly stated otherwise by Clackamas Ultrazone.

c. Winners may be required to provide additional information or documentation for the purpose of prize verification.

d. By participating in the Fundraiser, winners voluntarily consent to the use of their name, picture, or likeness in marketing materials for promotional purposes related to future Fundraiser events, achievements, or community outreach. The usage of winners' personal information will be in accordance with applicable data protection and privacy laws.

Proceeds:

a. Breakdown of Proceeds:

45% of sales from each school will be allocated back to their school’s football program.

5% will be contributed to the Community Champion fund. This fund will collect a percentage from all participating schools and will be awarded to the school that sells the most tickets.

3% will be contributed to the Community Champion Runner-up fund. This fund will collect a percentage from all participating schools and will be awarded to the school that sells the most tickets.

47% will be utilized for administrative processing, including credit card processing fees, prizes, promotional material, online marketing, and staffing costs required to facilitate the Fundraiser.

Allocation of Funds:

At the conclusion of the raffle, the proceeds will be donated to the school. The funds may only be used for the benefit of the football program, athletic department, or general school community. No portion of the proceeds will be allocated towards wages, salaries, or employment contracts. The utilization of the proceeds earned during this fundraiser will be at the discretion of the football coach, athletic director, or other designated authority. In the absence of a school representative, Clackamas Ultrazone will decide how the money will be allocated.

Code of Conduct:

a. Respectful and Responsible Conduct: All participants in the Fundraiser, including ticket sellers, must conduct themselves in a respectful and responsible manner throughout the duration of the event.

b. Zero Tolerance Policy: Any form of harassment, discrimination, or inappropriate behavior will not be tolerated and may result in immediate disqualification from the Fundraiser.

Liability:

a. Exclusion of Liability: The School, its representatives, and Clackamas Ultrazone LLC shall not be held liable for any loss, injury, or damages arising from or related to the Fundraiser, the event, or the awarded prizes.

b. Indemnification of Ticket Sellers: Ticket sellers agree to indemnify and hold the School and Clackamas Ultrazone harmless from any claims, demands, or liabilities arising out of their participation in the Fundraiser.

c. Indemnification of Winners: Winners agree to indemnify and hold the School harmless from any claims, demands, or liabilities arising out of their participation in the Fundraiser or the receipt of prizes.

Modifications or Disagreements:

a. Clackamas Ultrazone reserves the right to modify, extend, or cancel the Raffle at any time, with or without notice, in the event of unforeseen circumstances or as required by applicable law.

b. In the event of a dispute between any party of this Agreement, Ultrazone Laser Tag has the final authority to decide the dispute. Ultrazone Laser Tag will seek to mediate a fair and balanced outcome to the dispute. All decisions will be made at the sole discretion of Ultrazone Laser Tag, and those decisions will be final.

Governing Law:

Applicable Law and Jurisdiction: These Terms of Service shall be governed by and construed in accordance with the laws of Clackamas County, State of Oregon, USA.

Entire Agreement:

Comprehensive Agreement: This Agreement constitutes the entire understanding between the parties regarding the Raffle, superseding any prior agreements or understandings, whether written or oral.

By participating in the Raffle, you acknowledge that you have read, understood, and agree to abide by these Terms of Service.
